<p>When a person dies after spending the final months or years in a nursing home, there may be a debt to the nursing home which will be due for payment.</p><p>These outstanding debts may cause stress for spouses, children and family members of the deceased. The following is a short guide to the way nursing home debts are treated in Ireland.<br />If in doubt, get independent legal and financial advice.</p><h3>Responsibility for Nursing Home Debt</h3><p>In Ireland, nursing home debt is the responsibility of the deceased's estate and is paid after their death by their personal representative (executor or administrator).</p><p>If the deceased was in the <a href="https://www2.hse.ie/services/schemes-allowances/fair-deal-scheme/about/">Fair Deal Scheme</a>, any outstanding loan facility from the HSE must be repaid from the estate (funded by the sale of the deceased’s property), usually:</p><ul><li>Within 12 months of death, or</li><li>Within 6 months if the home was sold (prior to passing away) or transferred.</li></ul><p>Nursing homes and the HSE can claim unpaid fees from the estate. If the estate is insolvent (has insufficient assets), these debts may go unpaid.</p><h4>The Deceased's Estate is Responsible for Outstanding Debts</h4><ul><li>Personal Representative: The executor (if there was a will) or administrator (if there was no will – known as dying intestate) will gather all the assets of the deceased.</li><li>Insolvent Estate: If the estate's assets aren't enough to cover the funeral expenses, administration costs, and debts, it is considered insolvent.</li><li>No Obligation for Children: Children of the deceased are not typically obligated to pay nursing home debts unless they were a guarantor for the debt or the debt was in their name as well. If the estate is insufficient to cover debts, the beneficiaries typically do not have to pay them personally.</li></ul><h4>Fair Deal Scheme and Loan Repayment</h4><ul><li>Loan Postponement: Under the Fair Deal Scheme, the HSE pays nursing home fees, and a loan can be taken out based on assets like property, with repayment postponed until after the person's death.</li><li>Repayment Timeline: This loan must be repaid within 12 months of the person's death, or within 6 months if their property is sold or transferred at any point.</li><li>Interest: If the loan is not repaid by the due date, interest will be charged from the date of death.</li></ul><h4>Process of Paying Debts</h4><ol><li>Funeral and Administration Expenses: The first priority is to pay for the funeral and the expenses of managing the estate.</li><li>Preferential Debts: Next are preferential debts like taxes.</li><li>Ordinary Debts: Finally, other ordinary debts, such as nursing home fees and other unsecured debts (like credit cards and loans), are paid from any remaining assets.</li></ol><h4>If There Are No Assets</h4><ul><li>If the deceased has no assets, the debts cannot be paid, and the creditors will likely have to write off the debt.</li><li>The HSE and other creditors cannot claim the debt from the family of the deceased unless they are legally responsible for it.</li></ul><h3>What You Should Do</h3><ul><li>Contact the Executor/Administrator: If you are a family member, you should contact the personal representative to understand the estate's financial status.</li><li>Contact the Nursing Home: They will have details of any outstanding debts owing or that may not have been covered by the Fair Deal if the deceased was in the scheme.</li><li>Contact the HSE: If you are unsure about the Fair Deal loan or the outstanding fees, contact the Health Service Executive (HSE) for clarity.</li><li>Contact <a href="https://www.mabs.ie/">MABS</a>: For further information, MABS – The Money Advice and Budgeting Service.</li><li>Fair Deal: <a href="https://www2.hse.ie/services/schemes-allowances/fair-deal-scheme/about/">About the Fair Deal scheme.</a></li></ul><p> </p>

<p>As someone who is usually quite involved and present around things that go on with my close family members, it took me by surprise to come home one evening and find out that my grandmother had started showing visible signs of Alzheimer’s dementia.</p><p>My mother had already expressed her initial emotional reaction to my father, which she then casually mentioned to me afterwards, the denial and optimism had set in. She was hopeful that it “might just be a UTI,” as we had heard that can disorientate elderly people’s minds.</p><p>My first visit to my grandmother soon after had me feeling this gloomy sense of reality. The previous months of her growing deterioration with daily tasks all started to add up as pieces to a puzzle we didn’t realise was being made, until she started insisting one person in our family was two.</p><h2>The Diagnosis and What Followed</h2><p>The next few months saw doctor and hospital visits, an official diagnosis, advice about what lay ahead with her condition, and, alas, the further aggressive deterioration we were to expect.</p><p>While feeling very emotional about it all, my outlook on the situation became very practical and logical. My grief‑stricken mother knew deep down what was necessary, but found it difficult to come to terms with it.</p><p>Looking back, placing a loved one into <a href="https://rip.ie/grief-and-bereavement-support/preparing-for-a-peaceful-death-conversations-that-matter-270">long‑term assisted living </a>is a permanent removal from their home, so of course it plays with heartstrings. It is permanent change, and prolonging the transition can come into play, even when it jeopardises your mental and physical health.</p><h2>Supporting a Parent Through an Impossible Decision</h2><p>For my mother, I tried to be sensitive regarding my advice for what needed to be done for the best interest of herself, my grandmother, and all of the affected family, while recognising that this is a big decision the whole family has to come to terms with and adapt to. During these times, while providing sensitive but logical advice and encouragement, I used to say to her, <strong>“You can’t save her, but you can help her.”</strong></p><p>My grandmother’s condition quickly worsened to the point of total dependency in the short space of a couple of months, and she couldn’t live at home anymore without 24/7 supervision and care, something unsustainable for her elderly husband and her ageing adult children with their own commitments.</p><h2>Understanding the Reality of Dementia</h2><p>Before this happened in our family, I had heard people talking about their grandparents or parents being diagnosed with Alzheimer’s dementia, but I never realised its severity, how it can be so much more than a “memory loss” issue and how much it can<a href="https://rip.ie/grief-and-bereavement-support/when-grief-triggers-anxiety-navigating-the-bodys-response-225"> impact a family mentally </a>and physically, along with the normal emotions felt regarding your loved one losing their mind and ability to function.</p><p>As my mother took turns with her sister to watch over my grandmother day and night as her condition worsened, while nursing home options were being explored, I reminded her that she would be able to enjoy spending quality time with her mother in a nursing home, making good memories with her while professionals provided the necessary 24/7 care she required.</p><h2>Helping Your Parent Face the Emotional Weight</h2><p>I understood and empathised with how hard and upsetting this decision was to accept and make, but I felt that my logical and practical outlook on what needed to be done was an important factor in this experience for my mother. It aided her in processing this emotionally vulnerable moment in her life, while building the courage to act on what was necessary, all in the name of being there for a loved one you hold very dear and want the best for.</p><p>No one wants to take their loved one out of their home, and no one wants to accept the beginning of the end for their parents, but from my experience, it’s really important to view the situation as it is and act on what’s truly needed. Because whether it’s liked or not, a reason for the necessary decision‑making will unfortunately come before you in due course.</p><h2>Creating a New Kind of Home</h2><p>What I learned, and am still learning, from this experience is how home truly is where the heart is. Even though my grandmother has been living in assisted living for some time now, her room has become an extension of the family home. It has become a familiar space filled with her photo frames, ornaments and belongings. It has all her personal things making her mark on the once bare room she moved into, and we decorate it according to the season or holiday to make her feel special.</p><p>Most importantly, even though she is no longer at home, she is still receiving the attention she got at home and still getting the love and companionship from us that she deserves until the end.</p><h2>You Can’t Solve Grief, But You Can Help</h2><p>There’s <a href="https://rip.ie/grief-and-bereavement-support/when-grief-goes-unrecognised-understanding-disenfranchised-grief-250">no set way of “solving” grief.</a> I couldn’t save my mother from the emotions and impact of what happened to my grandmother, but I could help her — by offering sensitive support and advice, leading towards a more comfortable situation for all involved. And that’s what I did.</p><p>It’s a new beginning and chapter, and a very emotional one indeed, but wouldn’t it be sad if it wasn’t sad? That’s what makes it human.</p>

<p>There is a particular kind of warmth that fills the house during an<a href="https://rip.ie/grief-and-bereavement-support/customs-and-traditions-of-an-irish-wake-283"> Irish wake</a>. It takes you by surprise the first time, the way grief and laughter sit so comfortably side by side, neither one apologising for the other. There is a generosity to the way Irish people grieve together that feels instinctive, almost ancient.</p><p>And that is because it is ancient. It goes back further than most people realise, to a tradition so old and so distinctly Irish that its loss, when it finally came, left a gap that is still strongly felt decades later.</p><p>The keening women. The bean chaointe. If you have heard of them at all, you probably have a vague impression of something wild and unsettling, wailing women in black at a graveside. The reality was both more complicated and more beautiful than that.</p><h2>Who were the keening women and what did they do?</h2><p>The word keening comes from the Irish caoineadh, meaning crying. Keening women were generally older, experienced in their craft, and came to wakes and <a href="https://rip.ie/grief-and-bereavement-support/endoflife-rituals-around-the-world-354">funerals </a>to give voice to grief on behalf of the bereaved family. They were paid, though not generously. Often not even with money. A glass of whiskey. Some snuff. But they were valued. Everyone understood what would be missing without them.</p><p>Keening was not simply crying. It was a skilled art form that sat at the meeting point between <a href="https://rip.ie/grief-and-bereavement-support/choosing-the-right-song-a-singers-guide-to-honouring-a-life-359">song and lament.</a> It contained raw emotion alongside deliberate structure, repeated phrases, rhythmic patterns, and the knocking of hands against the coffin. It was composed in the moment, specific to the person who had died, addressed directly to them. A keen named the person, praised them, and asked them, in the way grief sometimes demands, why they had gone. It would never be performed the same way twice, because no two lives were the same.</p><p>The keening tradition was older than Christianity in Ireland. Variations of death wailing have been found in indigenous cultures across Europe, the Americas, Africa and Asia. In Ireland, many believed keening was not just an expression of grief but a genuine necessity, that the soul needed to be sung free from the body before it could move on. The keener was a guide for the dead. An older woman. A neighbour. Someone who had done this before and knew how.</p><p>There is a thread too between the keening women and the banshee that shows how deep this runs in the Irish imagination. The bean sídhe and the bean chaointe were understood as counterparts. One sang death into the community. The other sang it out. Both are described as older women with long, unruly hair. In some beliefs, a keener who had not performed her duties correctly was doomed to become a banshee after death. The line between the human mourner and the supernatural messenger in this corner of Irish tradition is very thin.</p><h2>Why did keening disappear?</h2><p>The short answer is the Catholic Church. By the middle of the twentieth century, keening had been discouraged, frowned upon, and in some places actively suppressed for nearly three hundred years. Priests felt their authority over the funeral was undermined when a keening woman arrived and took over the room. The synods of the seventeenth century formally named keening women as something to be brought to an end.</p><p>But the Church alone does not explain it. Something else happened alongside the clerical disapproval, and it is arguably the sadder part. The women themselves began to feel ashamed.</p><p>As Ireland modernised, keening started to look like something from a past people wanted to leave behind. Victorian tourists doing the grand tour were actively advised to attend an Irish funeral and catch a keener, which tells you something about how it was being perceived from the outside. Exotic. Primitive. Strange.</p><p>The fact that keening was almost entirely a women’s practice made it easier to dismiss. These were older women, often associated with folk cures and the old ways, operating well outside the formal structures of the Church. Gradually, between the disapproval from above and the embarrassment from within, a tradition that had existed for centuries quietly folded.</p><h2>What can we learn from the keening women?</h2><p>Keening gave grief a sound. Not a tidy one, not a composed or rehearsed one, but a true one. It was a community saying together, out loud, that this person was here and now they are gone and that this is not a small thing. The keener spoke directly to the dead, named them, and mourned them in a way that was specific to that particular life rather than general to everyone. That specificity, that refusal to let a person dissolve into the universal language of death, is something formal ritual does not always manage.</p><p>There is also something to be said for the physicality of it. Grief lives in the body, and keening gave it somewhere to go. The rocking, the striking of hands against the coffin, the voice pushed up from somewhere deep. It broke something open. It forced you into the feeling rather than around it. These days, we have become very good at going around it.</p><p>The keening women understood something we are perhaps still circling back towards. That grief, when it is given room and voice and a community willing to hold it, does something that private grief cannot. It releases. It remembers. It says, without apology, that a life ending is worth making noise about.</p><p>That does not seem primitive. It seems like wisdom.</p><p> </p>
