PERSONAL DATA AND GENERAL PRIVACY AGREEMENT
1. PURPOSE AND DATA CONTROLLER
This Agreement has been prepared for the purpose of processing, protecting, and ensuring the confidentiality of personal data belonging to the Customer in accordance with the Personal Data Protection Law No. 6698 (KVKK) during the use of the website operated and integration software (Service) offered by Teknosit Yazılım Bilişim Teknolojileri (Service Provider). Every user receiving service from the website is deemed to have accepted this agreement.
2. PROCESSED PERSONAL DATA
In order to provide the services and perform licensing and invoicing transactions, the following data belonging to the Customer are processed:
- Identity and Contact Information: Name, surname, company title, T.C. Identity Number, Tax Number, Tax Office, telephone number, and e-mail address.
- Invoicing and Payment Information: Billing address, payment method, collection history (Credit card information is processed directly within the integrated virtual POS infrastructure; it is never recorded or stored on our servers).
- Technical and System Information: IP address, in-site movements, browser cookies, and secure API/database connection information provided for the operation of the purchased software.
3. PURPOSE AND LEGAL GROUND OF DATA PROCESSING
Your personal data is processed within the framework of the legal conditions specified in Articles 5 and 6 of the KVKK for the following purposes:
- Fulfillment of our contractual obligations and activation of software licenses,
- Ensuring data synchronization over cloud servers and stable operation of the technical infrastructure,
- Fulfillment of financial, tax, and legal obligations (issuing invoices, accounting records),
- Resolving technical support and ticket requests and notifying system updates.
4. TRANSFER OF PERSONAL DATA AND CONFIDENTIALITY COMMITMENT
- 4.1. The Service Provider undertakes to keep all personal data, trade secrets, and system passwords belonging to the Customer confidential.
- 4.2. The collected data will never be shared with or sold to third parties, advertising companies, or data brokers, unless the Customer gives explicit consent and approval, or unless officially requested by legal authorities.
- 4.3. Data can only be transferred to official authorities (Prosecutor's Office, Courts, Enforcement Offices, or Tax Offices) upon legal request for the fulfillment of legal obligations.
5. INTEGRATION PASSWORDS AND TECHNICAL DATA SECURITY
- 5.1. ERP passwords, database paths, and API keys entered into the system by the Customer to activate the software are protected by high-security encryption methods.
- 5.2. The Service Provider takes all necessary cyber security measures (SSL, Firewall, etc.) to ensure data security on the cloud server side. The Service Provider cannot be held liable for damages arising from password vulnerabilities, viruses, or user-sourced leaks on the Customer's own local server.
6. COOKIE POLICY
Our website uses mandatory and analytical cookies to improve the user experience of visitors, ensure the security of sessions, and analyze website traffic. Your personal identity information is not stored through cookies. You can disable cookies at any time from your browser settings.
7. RIGHTS OF THE DATA SUBJECT (ARTICLE 11 OF KVKK)
The Customer has the right to apply to the Service Provider at any time to:
- Learn whether their personal data is processed,
- Request information if processed,
- Learn the purpose of processing and whether they are used in accordance with their purpose,
- Request correction if incomplete or incorrectly processed,
- Request the deletion or destruction of data in accordance with the KVKK legislation.
8. RESOLUTION OF DISPUTES
In all kinds of disputes arising from the implementation of this Agreement, Kocaeli (Central) Courts and Enforcement Offices are exclusively authorized.
